Processing of personal data

Depending on the usage of the website the following personal data is processed.

Data retrieval from the website

On retrieving data from the website including single web pages withouth further information transfer all data is processed which the browser sends to the server with the request, including

  • the IPv4 or IPv6 address,
  • the time of the request,
  • the address of the requested web page or file, e.g. a picture,
  • the status of the request as HTTP status code,
  • the size of the transferred data,
  • the version and vendor of the browser used for the request,
  • the type of the used operating system and type of the used device,
  • the referrer address, i.e. the address of the web page from which the request was made.

The legal basis for the processing is article 6 paragraph 1 sentence 1 item f of the General Data Protection Regulation as the information is technically required to transfer the data requested from the website. The information is not requested by the website but automatically and actively transferred by the browser.

The personal data is processed as long as the transfer process is not finished which usually is a matter of a few seconds. A transfer to a third country is neither intended nor taking place.

The provision of the personal data is neither a statutory nor a contractual requirement or necessary to enter into a contract. The data is provisioned in order to enable the technical data retrieval process. Not provisioning the data technically prohibits the data retrieval process.

This website uses the following services which may collect data themselves:

  • Internet Archive: The audio player of songs uploaded to the Internet Archive are incuded into blog posts and pages. This lets your browser load the necessary data to display the audio player from the Internet Archive website. Internet Archive, 300 Funston Avenue, San Francisco, CA 94118, USA. Internet Archive privacy policy.
  • YouTube: Youtube videos are included into blog posts and pages. This lets your browser load the necessary data to display the video player from the Youtube website. Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google privacy policy.
  • SoundCloud: The SoundCloud audio player is included into blog posts and pages. This lets your browser load the necessary data to display the audio player from the SoundCloud website. SoundCloud Limited, Rheinsberger Str. 76/77, 10115 Berlin, Germany. SoundCloud privacy policy.

The request protocol contains an anonymous version of the IP address in which the provider-independent part of the address is set to zero. Therefore, the protocol data is no personal data.

The protocol looks like this:

Use of the comment function

When using the comment function all personal data is processed as when retrieving data from the website and in addition

  • the comment text,
  • the optionally given name,
  • the optionally given email address and
  • the optionally given website.

In addition an option can be set to store the given name, email address and website in a browser cookie. This function is for the user’s convinience, it is deactivated by default and has to be activated by the user. The comment function can be used without restrictions without setting a cookie.

The personal data is processed to display a comment below the corresponding article which is the purpose of the comment function and the intent of the person writing a comment.

Legal basis for the processing is article 6 paragraph 1 sentence 1 item f of the General Data Protection Regulation, as the data processing is technically necessary as well as article 6 paragraph 1 sentence 1 item a of the General Data Protection Regulation as providing the information is optional and therefore consent was given.

Comment data is stored as long as the website exists or until the right to withdraw of the consent, request erasure, restriction of processing or objection to processing is exercised.

The provision of the personal data is neither a statutory nor a contractual requirement or necessary to enter into a contract. The data is provisioned in order to enable the technical data retrieval process. Not provisioning the data technically prohibits the data retrieval process. Name, email address and website are given optionally. Furthermore, for this data any anonymous, pseudonym or fictional entries can be made. This does not affect the comment function. Only the comment text has to be given which is the basis of the comment function.

Furthermore, when submitting a comment data is sent to the external service Akismet der Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA, to check whether the comment is spam. Therefore, the following data is transferred:

  • the IPv4 or IPv6 address,
  • the address of the requested web page on which the comment is submitted,
  • the version and vendor of the browser used for the request,
  • the referrer address, i.e. the address of the web page from which the request was made,
  • the name optionally given with the comment,
  • the email address optionally given with the comment,
  • the website optionally given with the comment,
  • the comment text.

The data is sent to a server in the USA where it is analyzed and stored for comparison purposes for four days. In case a comment is considered spam it is stored for a longer period. Therefore, automated decision-making determines whether or not the comment is spam. The personal data is transferred to a third country – the USA.
